On Monday August 31, late in the afternoon, Village of Elwood filed a motion for preliminary injunction against the City of Joliet to prevent Joliet from taking any action on the NorthPoint project until the Elwood lawsuit is litigated. At the time, Joliet had not yet filed a response to Elwood. Since then, Joliet has filed a motion to dismiss. It is unclear and we are making no assumptions whether or not this action was part of Joliet’s decision to remove the NorthPoint vote from the September 1 meeting agenda. Judge John Anderson has recused himself from this case. The matter goes before a new judge on September 24.
